KILISMILE TRAILS LIMITED – Terms of Service

Welcome to KILISMILE TRAILS LIMITED! We specialize in providing unforgettable mountain trekking and safari expeditions throughout Tanzania. By booking with us, you agree to the following terms and conditions:

1. Definitions

  • Company: KILISMILE TRAILS LIMITED, referred to as “we,” “us,” or “our.”
  • Client: The individual or entity booking or participating in a tour, referred to as “you” or “your.”
  • Service: All tours, treks, safaris, and other travel-related services provided by the Company.

2. Booking and Payments

  • Reservation: A booking is confirmed upon receipt of a deposit, as specified at the time of booking.
  • Payment Terms: Full payment is required 45 days before the start of your tour. Late payments may result in cancellation.
  • Cancellation Policy: Cancellation requests must be submitted in writing. Refunds (if any) are based on how early the cancellation is made:
    • More than 45 days before: 75% refund
    • Between 34 and 15 days before: 50% refund
    • Less than 14 days before: no refund
  • Change of Plans: If you wish to alter your booking, contact us at least 15 days in advance. Changes may incur additional fees.

3. Health and Safety

  • Medical Condition: You are responsible for disclosing any pre-existing medical conditions or physical limitations that could affect your participation.
  • Insurance: All clients are strongly advised to obtain travel insurance covering health, accidents, and trip cancellations.
  • Assumption of Risk: Participation involves inherent risks. By booking, you acknowledge these risks, including potential wildlife encounters, physical exertion, and environmental hazards.

4. Liability

  • Responsibility: KILISMILE TRAILS LIMITED will not be held liable for accidents, injuries, or loss of property during the trip unless caused by gross negligence.
  • Force Majeure: We are not liable for delays or alterations caused by events beyond our control, including natural disasters, political unrest, or other unforeseeable circumstances.

5. Itineraries and Changes

  • Tour Modifications: We reserve the right to modify itineraries if necessary, considering weather, local conditions, or other factors. We strive to provide equivalent alternatives when adjustments are required.
  • Tour Cancellations: If we cancel a tour, you will be notified as soon as possible, and a full refund will be issued.

6. Code of Conduct

  • Client Behavior: We expect respectful behavior toward guides, local communities, and wildlife. Disruptive or harmful behavior may result in removal from the tour without a refund.
  • Environmental Responsibility: We encourage clients to respect nature, including leaving no trace, avoiding littering, and following all wildlife guidelines.

7. Personal Belongings

  • Responsibility: You are responsible for safeguarding your personal belongings during the tour. We do not assume liability for loss or damage to personal items.

8. Governing Law and Dispute Resolution

  • Jurisdiction: These terms are governed by the laws of Tanzania. Any disputes will be settled in the appropriate Tanzanian court.
  • Amendments: KILISMILE TRAILS LIMITED reserves the right to update or modify these Terms of Service at any time. Clients will be notified of significant changes.

9. Acknowledgment and Acceptance

  • By booking with KILISMILE TRAILS LIMITED, you acknowledge that you have read, understood, and accepted these Terms of Service.
